Please read this Acknowledgment and Consent ("Consent") carefully before subscribing to or using the Proactive Insight Health Platform (the "Platform"), operated by Proactive Insight Health Platform, LLC ("Company," "we," or "us"). By accepting this Consent and creating an account, you ("Subscriber," "you") acknowledge that you have read, understood, and had the opportunity to ask questions about this Consent, and that you agree to its terms.
The Platform is a cash-pay, subscription-based health and wellness information service. It is designed to help you track wellness-related information over time, receive general wellness education, and, if you elect, have certain wellness data reviewed by your assigned clinician for informational and educational purposes.
This is the most important part of this Consent. Please read it carefully.
Certain information you submit — including laboratory results, questionnaire responses, and self-reported assessments — is reviewed asynchronously (i.e., not in real time) by your assigned clinician, a licensed clinician associated with our independent clinical partner, Victory Health, LLC ("Medical Group"). Company is a technology and management company; Company does not employ your assigned clinician and has no authority over, and does not influence, any clinical judgment or decision. Your assigned clinician's review may result in a labeled result level (Low, Moderate, or Elevated) and general wellness guidance being made available to you on your dashboard. Your assigned clinician does not provide you with a diagnosis, a treatment plan, or a prescription through the Platform.
If a result suggests something worth discussing with a physician, you will be encouraged to follow up with your own primary care physician or another appropriately licensed provider. Your assigned clinician's guidance is not a directive, and you remain solely responsible for your own healthcare decisions.
If your subscription tier includes laboratory testing, tests are ordered by your assigned clinician, in that clinician's independent clinical judgment, through Fullscript or another laboratory-ordering vendor. You are responsible for the cost of laboratory testing, which is paid directly through Fullscript at the applicable cash-pay rate and is separate from your subscription fee. You will typically complete the blood draw at a Quest Diagnostics or LabCorp patient service center, or you may upload results from your own outside provider.
Do not use the Platform for medical emergencies.
If you are experiencing a medical emergency, call 911 or go to the nearest emergency room immediately. If you are experiencing a mental health crisis or having thoughts of harming yourself, call or text 988 (the Suicide & Crisis Lifeline) or go to your nearest emergency room. The Platform is not designed or intended to respond to emergencies and clinical review of your information is not immediate.
You should maintain an ongoing relationship with your own primary care physician and should not discontinue, delay, or forgo any medical care, medication, or treatment because of anything you see on the Platform. Any general wellness suggestions provided through the Platform are educational only and are not a substitute for individualized medical advice from your own treating provider.
Information you provide through the Platform — including your laboratory results, PHQ-9 mental health screening responses, musculoskeletal and cognitive assessment responses, and any clinician-generated result labels or notes — constitutes protected health information ("PHI") under the Health Insurance Portability and Accountability Act ("HIPAA"). Company handles your PHI as a business associate of Medical Group, pursuant to a Business Associate Agreement between Company and Medical Group, and only as permitted by HIPAA. A full description of how we collect, use, and share your PHI — including who it is shared with and your rights with respect to it — is set out in our Privacy Policy, which is incorporated into this Consent by reference. Please review the Privacy Policy before proceeding.
By accepting this Consent, you confirm that you have read and understand this Consent, have had the opportunity to ask questions about its contents, and that any questions you had have been answered to your satisfaction. You further confirm that you understand and voluntarily agree to each of the following:
Acceptance of this Consent is a single, combined acknowledgment of all of the above; there is no partial acceptance.
This Consent, together with the Terms of Service and Privacy Policy, is versioned. If we make a material change to this Consent, you will be asked to review and re-accept the updated version before continuing to use certain features of the Platform, as described in the Terms of Service.
Subscriber acceptance is captured electronically, together with the version number and timestamp of this Consent, in Company's consent management system.
