These Terms of Service ("Terms") govern your access to and use of the Proactive Insight Health Platform ("Platform"), operated by Proactive Insight Health Platform ("we," "us," or "our"). By creating an account or using the Platform, you agree to these Terms.
Proactive Insight Health Platform is a preventive health information platform that provides educational health insights based on your personal health data, reviewed by licensed clinicians. The Platform is not a medical practice, does not provide medical advice, and does not diagnose or treat any medical condition.
The information provided through the Platform is for educational and informational purposes only. It is not a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of your physician or other qualified health provider with any questions you may have regarding a medical condition. Never disregard professional medical advice or delay seeking it because of something you have read on this Platform.
Clinician review services are provided by an independent licensed Medical Group, not by Proactive Insight Health Platform. Clinicians review and release health data at their sole clinical discretion. The Platform facilitates clinician access to your data but does not direct, supervise, or control clinical decisions.
You may optionally connect wearable devices (such as Oura Ring) to enhance your health insights. By connecting a device, you authorize us to access data from that device as described in our Privacy Policy. You may disconnect devices at any time. Wearable data is used for informational purposes only and does not constitute medical-grade monitoring.
If you are experiencing a medical emergency, call 911 immediately. If you are experiencing thoughts of suicide or self-harm, contact the 988 Suicide and Crisis Lifeline by calling or texting 988. The Platform is not equipped to provide emergency medical services.
All platform technology, content, algorithms, scoring logic, and user interface elements are the exclusive property of Proactive Insight Health Platform. You may not copy, reproduce, or distribute any platform content without written permission.
To the maximum extent permitted by law, Proactive Insight Health Platform shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform. Our total liability to you for any claims arising from these Terms shall not exceed the amount you paid us in the 12 months preceding the claim.
The Platform is provided "as is" without warranties of any kind. We do not warrant that the Platform will be uninterrupted, error-free, or that health insights will be accurate for your specific situation. Health data interpretation involves clinical judgment — band-level insights are educational only.
We may suspend or terminate your account if you violate these Terms, provide false information, or if continued operation creates regulatory or legal risk. You may terminate your account at any time by contacting us. Upon termination, your health data will be retained as required by applicable law.
These Terms are governed by the laws of the State of Alabama, without regard to conflict of law principles. Any disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.
We may update these Terms from time to time. Material changes will require your re-acceptance before continued use of the Platform. Continued use after notice of changes constitutes acceptance of the updated Terms.
